...................................................................................................... 33 ARTICLE I RECOGNITION AND SCOPE 1.1 PARTIES TO THE AGREEMENT This Agreement is made and entered into by and between the Board of Education of Franklin Park Public School District No. 84, Cook County, Illinois, hereinafter referred to as the “Board” and the Franklin Park Custodian Council, West Suburban Teachers’ Union, Local #571, IFT, AFT, hereinafter referred to as the “Union.” Where appropriate, the term “Board” when used in this Agreement shall be understood to include the superintendent and other authorized agents of the board. 1.2 RECOGNITION The Board recognizes the Union as the exclusive bargaining agent for all full-time custodial and maintenance employees. Excluded employees are: Director of Buildings and Grounds, those employees assigned as custodians only for the summer, managerial, confidential and short-term employees. ARTICLE II UNION RIGHTS 2.1 Work Day Discussions Upon mutual agreement of the Board and the Union, members of The Administration and Union officials may meet to discuss mutual concerns during the work day. 2.2 DUES DEDUCTION The Board shall deduct from the regular paycheck of each employee, from whom it receives written authorization to do so, the required amount of Union dues. The dues and a list of employees from whom the dues have been deducted and the amount deducted from each shall be forwarded to the proper Union officer no later than twenty-five (25) days after such deductions are made. 2.3 SCHOOL BUILDINGS AND EQUIPMENT The Union shall have the right to use school buildings for Union meetings, provided: that the building principal is notified five (5) calendar days before any such meetings; that no extra custodial help is necessitated because of such meetings; and that such meetings are during non-school hours and do not interfere with any facet of the school’s educational or administrative business. The Union shall also have the right to use the school’s duplication equipment during nonschool hours provided that the Union reimburses the District for the cost 1 of any materials used and such use does not interfere with any facet of the school’s educational or administrative business. 2.4 BULLETIN BOARDS The Board agrees to provide an area adjacent to the custodians’ work area in each school building for the Union to post one (1) bulletin board, which shall not exceed three (3) feet by three (3) feet in area, for posting only the following official Union notices: a. Notice of Union recreational and social activities; b. Notice of Union elections and results of such elections; c. Notice of Union appointments; d. Notice of Union meetings and reports and minutes thereof; If the Union desires to post any other Union notices, the Union shall submit a copy to the Superintendent contemporaneous with the posting of the notice on the bulletin board. 2.5 SCHOOL MAIL The school mailboxes and the district’s e-mail may be used by the Union to facilitate the dissemination of officially identified Union material within the district. Materials and communications within the district, including e-mail communications, shall not be used to malign the administration or the Board. A Union officer or his or her designee will be permitted to distribute such material during non-working hours without prior administrative approval. Non-working hours shall mean before work, after work, break time, and lunch/dinner time. All e-mail communications shall be in compliance with, and subject to, the district’s Access to Electronic Networks Policy. 2.6 FAIR SHARE 2.6.1 All employees hired after June, 1994 and who have not made application for membership with the Union shall, on or after the thirtieth (30th) day of their hire and for as long as they remain nonmembers of the Union, pay to the Union a fair share fee (not to exceed the amount of Union dues) of the cost of the collective bargaining process and administering the contract relative to matters affecting wages, hours and other conditions of employment. After thirty (30) days, in absence of a membership card, the Union president shall inform the Board in writing to begin fair share deductions for new employees 2 and specify the amount to be deducted each payday through the end of the fiscal year. Employees hired prior to July, 1994 who are not Union members as of July 1, 1998 but choose to become members and thereafter withdraw from the Union shall be required to pay the Union a fair share fee and shall lose their grandparented status. 2.7 2.6.2 The Union shall certify to the Board a fair share amount not to exceed the dues uniformly required of members in conformity with federal and state laws and labor board rules. 2.6.3 Such fair share payments by nonmembers shall be deducted by the Board from the earnings of the nonmember employees and remitted to the Union no later than twenty-five (25) days after such deductions are made. 2.6.4 The Board shall cooperate with the Union to ascertain the names and work locations of all employees who are not members of the Union from whose earnings the fair share payments shall be deducted. 2.6.5 The Union shall indemnify and hold harmless the Board, its members, officers, agents, and employees from and against any and all claims, demands, actions, complaints, suits or other forms of liability that shall arise out of, or by reason of, any action taken by the Board for the purpose of complying with this Article. CONTRACT COSTS The cost of printing and duplicating this agreement shall be paid for by the Board, and a copy of the agreement will be given to each employee. 2.8 DISTRICT CALENDAR Prior to the Board’s adoption of the calendar for each school year, the Union may submit a list of concerns and suggestions regarding the establishment of the school calendar and may request a meeting to discuss such concerns and suggestions. Once the school calendar has been established, no changes shall be made without informing the Union in order that the Union, if it so desires, shall be able to submit its opinions and suggestions to the Administration. Any suggestions or opinions must be submitted within three (3) working days after the Union has been notified of the intention to change the calendar. 3 2.9 NEW FACILITIES AND POSITIONS On an annual basis, the Union may request to meet with the Board to discuss the need for new facilities and positions. The request for a meeting shall be made in writing to the Superintendent’s office at least five (5) days prior to a regularly scheduled school board meeting. The meeting shall be scheduled at a time and place which is agreed to by both the Union and the Board. Additional meetings may be scheduled with the mutual consent of both parties.
